Financial Liability of the Third Party

Financial Liability of the Employer:
Legal responsibility for occupational accidents that may occur in the workplace belongs to the employer. Employer’s Liability Insurance covers the indemnities that can be demanded from the employer by the workers connected to the employer with a service contract and subject to the Law of Social Insurance or their beneficiaries, and the compensation claims above and outside the benefits provided by the Social Security Institution. In case of a lawsuit regarding this insurance, litigation costs and expenses and attorney fees are also considered within the scope of the coverage.

THE FOLLOWING RISKS CAN BE INCLUDED IN THE COVERAGE WITH THE EMPLOYER’S FINANCIAL LIABILITY INSURANCE:

  • Occupational accidents that occur when workers are transported to and from the place of work in a vehicle provided by the employer,
  • Occupational accidents that occur when the workers are sent to another place by the employer and during the time when they are not doing their main job,
  • Occupational accidents that occur outside the boundaries of the Republic of Turkey,
  • Indemnity claims arising from occupational diseases,
  • Claims for non-pecuniary damages,
  • Subcontractors and interns,
  • Incidental construction works,
  • Food poisoning,
  • Private hospital expenses to be valid in emergency situations without the need for SSK (Social Security Institution) referral,
  • Employees working within the scope of İşkur (Turkish Employment Organization)
FINANCIAL LIABILITY INSURANCE OF THE THIRD PARTY

In case of death, injury, deterioration of health and/or material damage, loss and damage to third parties as a result of an incident that occur during the activities of the insuree, it is ensured that the insuree is covered within his/her legal liability and within the limits specified in the policy.
Within the scope of the General Conditions of Financial Liability Insurance of the Third Parties, the aforementioned coverage covers the claims for damages and losses that may be claimed as a result of the fault of the insuree.
Within the scope of the financial liability of the third party, the following risks can be additionally included in the insurance coverage.

  • Liabilities arising from material and physical damages that third parties may suffer as a result of fire, explosion, internal water, and smoke,
  • Liabilities arising from material and physical damages that third parties may suffer during incidental construction works within the risk address,
  • Elevator liability,
  • Parking lot / valet liability,
  • Claims for non-pecuniary damages,
  • Billboards, Signboards,
  • Food poisoning.
